Obviously, every case is different. But as a general rule, the more serious the injury, the longer it takes. For example, if you have what we would call a whiplash or a minor injury, soft tissue meaning that there's no broken bones there’s no herniated discs, you have neck and back pain; but you see a chiropractor or an orthopedic surgeon and you treat it for three, four months or so, then that kind of case can settle out in, in in a few months. If you have something more serious, somewhat we call objective injuries, herniated disk, a torn ligament, things of that nature, your treatment may be longer than a three four-month period. It may be six months to a year, so your case would be that much longer than the smaller injury. Then we have cases with you know, more catastrophic type injuries that require multiple hospitalizations or surgeries and your treatment may go on for a year or two. Obviously, those cases are going to take a lot longer to settle than the smaller cases. In addition to that, once a case gets resolved in regards to the medical treatment, we have to get the reports in from the doctors and all the bills, we have to submit those to the insurance adjuster. The insurance adjuster then takes his time in regards to evaluating all the medical reports. Once we get offers in, we don't accept the first offer. So then the negotiation process takes place where we go back and forth with the adjusted and finally get a number. So that can take some time between you know, the first offer and the last offer many times I've heard an adjuster say that's my bottom line. You know, three or four years later, it really wasn't their bottom line. So the negotiation process can take some time as well. So a smaller case, three to six months, middle of the road case, you know about a year or so, more complex injury, one or two years or even longer depending on you know, the seriousness and how many surgeries and hospitalizations, etc. But hope that gives you a general idea of how long a personal injury case takes to settle.

Technically speaking, if you get injured on a Monday morning, you can file an injury claim Monday afternoon. I mean, it's just a filing fee, going down to the courthouse, and filing a complaint against the other party. I wouldn't necessarily recommend that, although it's been done. I think that after an accident, you need to circle the wagons, and gather your information, and assess the extent of your injuries. To make an intelligent decision on whether to file based upon all the facts and information available. Of course, there are some exceptions to this such as a serious injury that you need to get into the courthouse ASAP so that you can get subpoena power and get certain information about the other party. So there is justification to file it immediately. The statute of limitations in Florida is four years. So you have up to four years to file a lawsuit from the date of the accident, but technically you can file it the same day that you were injured.

Very simple, call 305-931-6666 and talk to me and I'll lead you through it. Short of that, here are some other things that you should keep in mind. Number one, the other person's insurance company is not your friend, do not speak to them until you've hired an attorney. Do speak to your own insurance company, but get a claim number. If they want to take a recorded statement. Tell them Yes, I want to give you a recorded statement. But I want to coordinate it with my attorney. You can't say something wrong if you don't say anything at all. You should consult with your attorney before you give any statements to anyone. You have an obligation to give it to your own insurance company, you do not have to give one to the other person's insurance company. They are not your friend. Don't do it. Witnesses, many times, I'll ask my client. Do you have any witnesses? They Yeah, yeah, I have a witness but they have no idea of the person's name, or how to contact them. A Witness can be great in your favor. But if you can't find them, they're no good to you. So get names, phone numbers, a way to contact any potential favorable witness on your behalf. Documentation, documentation, documentation. Get photographs of any vehicles or the scene of the accident or whatever it is that we're trying to prove. Photographs of any injuries black or blue marks, fade, scratches fade, they go away over time. Document your injury with photographs, ASAP. See a doctor whether it be in an emergency room, your family doctor, document somehow, someway, what it is. When you see that doctor, anything and everything that's wrong as a result of this accident, you need to document. I want to be able to tell an insurance adjuster that from day one, my client had XYZ injury. If you don't document it, then the judge is going to try and say well, it's kind of strange that they never mentioned anything about that part of their body when they went to go see the doctor for the first time. So these are arguments made by insurance adjusters that we want to prevent by you documenting everything that's possibly wrong. I hope this is helpful.

Florida no-fault law says it doesn't matter who is at fault in an automobile accident, your own insurance company pays for your medical bills. That is Florida no-fault law. But now let's talk about practicalities. Many clients come to me and say, I don't want my insurance company paying for my medical bills, because my rates are going to go up, let me go through my health insurance. No, no, no, no, that's not the way the law works. You're not saving anything on your insurance with your own company, either. The way it works is your PIP, Personal Injury Protection, pays your medical bills. They then have a right of what we call subrogation. So whatever they paid out on your behalf, they're going to be able to go against the other person's insurance company and have them reimburse for the money that they paid out for you. So your rate should not go up because they have a way of getting reimbursed for what they payout. In addition to that, you don't want your health insurance paying out instead of your PIP, because at the end of the case, your health insurance is going to have their own subrogation rights against you. PIP does not have subrogation rights. So whatever they paid out on your behalf, they can't collect back from you. But your health insurance, if you receive money from the other party, the health insurance is then going to go ahead and say we want reimbursement because we paid out medical bills on your behalf. So you want your no-fault insurance to pay. You don't want your health insurance to kick in until later so that you can keep your subrogation from the health insurance as low as possible. In addition to that, keep in mind that doctors often if they know the attorney that's representing you will see you on what's called a letter of protection. So even if you don't have PIP or health insurance, you can still get medical care if you go to the right attorney who knows the right doctors who are going to understand that it's a long, long game here. That they will go ahead and treat you at the end of the case, the attorney will then pick up the phone and speak to your doctor and say listen, here's what the client received. Let's do an equitable distribution here of how much the client receives and how much you'll accept as payment for your medical bill. So there are ways to work out the medical liens from your doctors, as long as you have a good relationship with your attorney and the health providers that you work with. They'll come to an equitable agreement in regards to how much to reduce their bills in order to make sure that everybody walks away with a fair share. So priority number one, you want your PIP to pay. Number two, if there's no PIP, then, of course, health insurance, but keep in mind health insurance is going to have subrogation rights, and that's going to be dollar for dollar out of your pocket at the end of your case. If all else fails, we go ahead and sign letters of protection. Your doctor then is contacted by your attorney at the end of the case, and they work out an agreement of how much is fair in order to resolve your case, equitably for all involved.

TBI’s is something that is a very serious topic and should be treated accordingly. When you're involved in a motor vehicle accident, sometimes people say, oh, you just have a whiplash. Well, actually when your neck goes forward and accelerates back, as quickly as it takes place, in a car accident. You actually can receive microscopic tears in your brain cells that don't show up so easily on an MRI. But it does show up in some of the symptoms that you have. Oftentimes, I'll be interviewing a new client, and I'll ask them in the middle of the interview... Let me ask you something. Do you have a sensitivity to noise lately? Like maybe while watching TV? And I go, yeah, as a matter of fact. I'll ask them other questions like, are you sensitive to light? Are you becoming more impatient with your children or at work or with your spouse? Do you have forgetfulness and memory issues? I go through the list of traumatic brain injury type of symptoms, and the client will sit there and go, yes, as a matter of fact, Mr. Neufeld, I do have these things. I'll explain to them that oftentimes, it's missed. If he or she is having these types of symptoms, I'll recommend a neurologist to go check out this client. More times than not, they will pick up on traumatic brain injury and this will enhance the value of the case, it’s something that goes undiagnosed, or can go undiagnosed. Unless you have a trained eye and you have a feel for what to be looking for, it could be very easily overlooked. So traumatic brain injuries is a very serious issue, it goes hand in hand with car impacts, and the whipping of the head sideways or forward and back. Those microscopic tears aren't easily picked up by neuropsychological tests and neurologists. These are the type of examinations and tests that one needs in order to document this type of injury and be able to get compensated accordingly.

First of all, let's realize one thing. The insurance industry is a multi-million, if not, billion-dollar industry. They're in the business to do one thing... make money. They're not your friend. The insurance industry, the insurance adjusters who do bodily injury work, they know the good attorneys from the bad attorneys. So if you go and find an attorney that advertises that they do taxes and real estate and divorce, and they'll close on your house; the insurance people know that that's not a trial litigation attorney. That's not a personal injury person that can back up what they say in regards to threatening to file a lawsuit on their client's behalf. You want an attorney that's been successful, that's kicked the butts of the insurance people. So that the next time that attorney comes around, it grabs their attention, they go, we better listen to this guy because he knows what he's doing, and he can back up what is what he's saying. So you want a successful trial attorney. There are many attorneys that hold themselves out as personal injury attorneys, but they wouldn't know the courthouse if it bit them in the derriere. I’m telling you, you want an attorney that can back up his punch, that can back up his threat, that can tell an insurance adjuster. I'm going to beat your butt if you don't go ahead and resolve this case with my client and they know you have a history of doing it. The best way to get the most in regards to a settlement on your case is they have a hammer over their head. They know that their heads about to get cracked open by your attorney. If they don't have that threat, don't think that they're going to settle your case out of the mercy of their heart. They're going to try and limit how much they pay. They will pay the most when they have the most to lose, and they'll have the most to lose when the threat is the greatest. When the threat is the greatest when there is an attorney in your corner that knows what he's doing, has a track record with this insurance company and they know that if they don't resolve it reasonably now, that he'll go to trial and get something significant for you, so much more so than an attorney that doesn't have the experience in personal injury litigation.
